A Cape Cod man won $1 million in the Massachusetts state lottery, but he might not be able to keep it.
Timothy Elliot of Hyannis, Mass., had robbed two banks in the past and was not eligible to buy lottery tickets, reports CBS station WBZ-TV in Boston.
Elliot bought a $10 ticket for the $800 Million Spectacular instant game at Stop and Shop in Hyannis. He picked up the first of 20 annuity checks for $50,000 before taxes on Monday at lottery headquarters in Braintree, Mass.
Authorities told WBZ that Elliot had pleaded guilty to robbing banks in February 2001 and January 2006. After each robbery he was sent to a mental hospital.
After the 2006 robbery, Barnstable Superior Court Judge Gary Nickerson told Elliot that as part of his probation he was not allowed to gamble or purchase lottery tickets.
Nickerson refused to comment Wednesday.
A hearing has been scheduled for Dec. 7 in Barnstable Superior Court.
It is likely Nickerson will decide at that hearing if Elliot gets to keep the money. There's also the possibility he could be sent to jail for violating his probation.
The lottery told WBZ no one has contacted them about Elliot, who has not been available for comment.
If he is allowed to keep his winnings, his next check would be given to him next year.
