You may have thought Gov. Arnold Schwarzenegger just made up the idea of paying state workers minimum wage until the budget gets passed. Not so. The governor has clever lawyers, and they found a legal finding that actually encourages minimum wage payments.
The state Supreme Court ruled five years ago that state employees can't be paid at all until the budget is passed. The exception is the state's hourly workers, who are entitled to minimum wage under federal law.
Nobody paid much attention to the ruling until the governor's lawyers dug it up. The problem is, the threat didn't scare the legislature five years ago, and isn't scaring them now. It just makes the governor look like a bully, and takes the spotlight off the legislature.
