No Criminal Charges For Comments Made By Duvall

SACRAMENTO (CBS13) ― The Department of Justice and the FBI announced Monday they will not file charges in connection with comments made by former California Assemblyman Mike Duvall.
In a press release issued today, the Department of Justice said the FBI had concluded its preliminary investigation into Duvall's comments and determined they did not not warrant prosecution by the U.S. Attorney's Office.

Last week, a state watchdog commission also decided not to pursue an ethics investigation into the sex scandal that brought down a Republican state lawmaker.

A complaint was filed by an activist over the sexually explicit remarks made by Duvall during a summer meeting. He was caught on tape bragging about sexual affairs with two women, one of whom was a lobbyist for an energy company. At the time, Duvall was vice chair of the Assembly Utilities and Commerce Committee, where he authored 20 bills, one on electricity rates.

Derek Cressman, a member of the group Common Cause, filed a complaint with the FPPC on October 14 alleging that the relationship between Duvall and the two women violated state laws.

In a statement, the FPPC said that there wasn't enough evidence of wrongdoing.

"Regrettably, the only evidence you provided in support of your claim was the referencing of a number of media reports that detailed former Assembly Member Duvall's statements," the report said.
