The woman who filed a lawsuit against Ben Roethlisberger reportedly sent an e-mail saying she was going to dinner with him less than 24 hours after the alleged assault, reports CBS station KDKA-TV in Pittsburgh.
According to KDKA news partners at the Pittsburgh Post-Gazette, nearly two dozen e-mails and roughly 150 instant messages were recently released by Roethlisberger's attorney William David Cornwell Sr.
Cornwell says the e-mails prove that Andrea McNulty was not raped.
One of Mcnulty's emails reads:
"This golf tournament has been really fun. I am beat though because we are out until four in the morning by the time we are done."
She's talking about the celebrity golf tournament in Lake Tahoe that Roethisberger was attending in July, 2008.
McNulty claims she was sexually assaulted by Roethlisberger at Harrah's Lake Tahoe where she worked on July 11, 2008.
This message is dated the day after - in the evening. It reads:
"I am really excited because we are all going to see Journey tonight and that will be sooooo much fun. Speaking of which, I need to head over to a dinner with [referring to Roethlisberger] and a few others before heading out. I will be back and working until at least 3 a.m. again."
McNulty's messages were sent to a man, who in reality didn't exist.
The account reportedly was a fictional soldier made up in hoax orchestrated by a woman who believed her husband had an affair with McNulty.
Five months after the alleged assault, McNulty writes an instant message:
"I would date Ben Roethlisberger."
She goes on to write:
"I'm dead serious... (Mr. Roethlisberger) said he would take me to this place he has in Wyoming and they horseback into this fishing hole and camp."
In another development, one of the other defendants named in the lawsuit has filed a motion to have the case dismissed.
Former Harrah's employee and former best-friend of McNulty, Stacy Dingman, filed the motion because she thinks the lawsuit is baseless. She also feels that she was dragged into it without justification.
