Missed Mortgage Payments But Want To Keep House
Question: I am 9 months behind on my mortgage. I was working with my lender to modify my loan. After 4 months of paying the loan modification payments to my lender they came back and said they denied our modification do to our house not being reaffirmed in our bankruptcy in 2007. I called my attorney to question what this meant and he said he did not reaffirm the house and he usually doesn't with homes unless they send him paper work and he says our lender did not send him anything. We did file in 2007 and wanted to keep our house and we were doing ok until my husband lost his job in construction and has not been able to find work. He had first lost his job in March then went back to work in May and then was laid off again in October and has not worked since. We would really like to stay in our home but our lender won't modify unless we reaffirm our house. Do you have any suggestion's or advice as to how I might be able to stay in my home.

Answer: Stacey, I'm sorry to hear about your troubles of the last two years. It takes a lot of persistence to get your mortgage modification to be taken seriously by the servicer. I would suggest you call them daily for the next 60 days, stating your desire to stay in the home and your ability to pay the prior mortgage modification payment. I have talked with people that it took weeks and sometimes months of calling before they were taken seriously. In this case, "the squeaky wheel gets the grease", and if you really want to stay in your home, I would suggest escalating your interaction with the mortgage servicer.
