Driver In Fatal Crash To Be Charged With Murder
WOODLAND, Calif. (CBS13) ―
The driver of a vehicle that crashed near Woodland Monday, killing a 10-year-old girl and leaving a baby boy in critical condition, will be charged with second-degree murder, says the CHP.
Arnold Barraza, 25, of Woodland, was allegedly driving under the influence when the car he was driving crashed on County Road 22 near Woodland on Tuesday afternoon. Because he has had two prior DUI convictions, he will be charged with second-degree murder, according to the CHP. Charges were expected to be filed against Barraza when Wednesday when he is released from the hospital. He will also be charged with two charges of child endangerment. The DUI charge will be filed once a conclusive blood test comes back; results of that test could take up to 10 days.
Cierna Martinez, 28, of Woodland will also be charged with three felony counts of child endangerment once she is released from the hospital. She is listed in grave condition.
Officers say the vehicle flipped and rolled into a grassy ditch along the highway. The three children in the car were in not in car seats, and all were ejected from the vehicle, says the CHP.
Destiny Martinez-Gonzalez, 10, was killed instantly. Arnold Barraza Jr., 1, was rushed to the hospital and is still in critical condition. Elise Gonzalez, 4, also suffered major injuries. She was released from the UC Davis Medical Center Tuesday.
Both adults in the car were wearing seatbelts and suffered major injuries.
Martinez is believed to be Barraza's girlfriend, according to reports.
