The Stanislaus County man accused of beating his son to death on a rural Turlock road in June wasn't on drugs or alcohol at the time, according to the Stanislaus County's Chief Coroner.
"Sergio Aguiar did not have drugs or alcohol in his system at the time
of his death," said Kristi Ah You, Stanislaus County's Chief Coroner in a press release issued today.
According to witnesses, the 27-year-old man allegedly beat his infant son as one man tried to intervene. Dan Robinson jumped out of his vehicle and tried to stop the suspect from kicking and stomping a toddler to death.
Robinson,
who is the chief of the Crows Landing Volunteer Fire Department, says
Aguilar had a "total hollowness in his eyes" and talked calmly of the
boy being filled with "demons."
A Sheriff's Department helicopter arrived on scene before any units on the ground.
The
helicopter crew saw the man kicking a baby in the head, according to
authorities. The crew made an emergency landing in a nearby cow
pasture, and a Modesto police officer left the aircraft and moved
toward the man.
The officer, Jerry Ramar, fatally shot Aguiar
after he failed to heed the officer's warning to stop beating the
child, authorities said. Aguiar flashed his middle finger at Ramar
before Ramar shot him in the forehead, police said.
The infant was rushed to an area hospital but was pronounced dead. A DNA test proved that Aguiar was the infant's father.
