Bill To Document Rape Kit Testing Reintroduced

  A state assemblyman has reintroduced a bill that would require police to document their progress in testing evidence from rapes, after Gov. Arnold Schwarzenegger vetoed similar legislation earlier this month.

   The bill by Democratic Assemblyman Anthony Portantino would require law enforcement agencies to report the number of rape kits received and tested, and how many remain untested. The information would be sent to the state Department of Justice.

   The kits contain the evidence collected after a sexual assault, which that can be compared to DNA samples. Last year, Los Angeles police said they had nearly 7,500 untested kits.

   In his veto, Schwarzenegger said the bill would not ensure more kits are tested.

   Portantino says he was surprised by the veto.
