Suspect In BART Arrest Facing Misdemeanor Charges

A man involved in an incident with a Bay Area Rapid Transit officer shown on the Internet will not face felony charges.
Michael Gibson appeared in Alameda County Superior Court on Tuesday and pleaded not guilty to misdemeanor charges of disturbing the peace, public drunkenness and indecent exposure.
Gibson was facing possible felony charges for after police said he hit a BART officer and resisted arrest.
The weekend incident was caught on cell phone video and posted online. It shows the officer pulling Gibson off a train in West Oakland and pushing the suspect toward a glass wall.
The glass broke, causing minor injuries to both men.
Gibson remains in custody on $5,000 bail and scheduled back in court on Dec. 17.
