Police Arrest Local Man For Sixth DUI Conviction

SACRAMENTO (CBS13) ― Five DUI arrests and a Sacramento man was still behind the wheel when police arrested him this morning for an alleged sixth DUI. CBS13 asks the question, how could this man still be on the road?

Marvin Gaye Adams just does not get it. Mothers Against Drunk Driving says Adams is one of the 350,000 people driving in California with three or more DUI's on their record. Records show 44,000 has five or more convictions.

"He is probably going to go to prison at this point," says Harlan Antler.

Defense attorney and DUI expert, Harlan Antler, does not represent Adams but says the fact that he's never hurt anyone any of the times he was convicted of driving under the influence is part of the reason the most time he's spent in jail was 15 days.

When CBS13 requested to speak with Adams behind bars, he refused to speak with our reporter. Adams said," No, I don't know why that guy wants to talk to me." The reason for speaking with Adams is due to the fact that this is his sixth DUI in the last 16 years.

Adams received his fifth DUI in October and got of jail on November 4th. Then, 17 days later, police charged Adams with his sixth DUI.

"After the third, the person should have been declared a habitual traffic offender, which means if he drives at all, four inches in his driveway, without a drop of alcohol in him, he can go to jail for a year," says Antler.

CBS13 could find nothing in Adam's records to indicate he has been declared a habitual offender. Had that happened, he may still be in jail. But, last month he was released with an electronic monitoring device.
