In a lawsuit filed last week, Ohio couple Teresa and Michael Jacobs claim doctors "hastened" their son's death and "intentionally killed" him in order to harvest the organs of their 18-year old, Gregory, who had suffered a traumatic brain injury.
Gregory Jacobs suffered a snowboarding accident in 2007 and was taken to Hamot Medical Center for treatment.
The Jacobs maintain Gregory was not formally "brain dead" when surgeons began the transplant procedure five
days following the accident. The parents spoke with CBS Early Show anchor Maggic Rodriguez on Monday.
"Our experts are telling us that, had his organ not been taken, he may very well may have survived and recovered from this accident," said Dennis Boyle, the Jacobs' attorney.
A district attorney's investigation concluded nothing criminal was done, and the Center for Organ Recovery says they followed all protocols.
"I believe that's false," said Teresa Jacobs. "I would like to see the ones responsible for Greg's killing to be held responsible."
The Hamot Medical Center issued a statement denying the Jacob's accusations and said it would defend itself "against any accusations of wrongdoing."
Michael Jacobs claims staff persuaded him into signing into shutting down life support services to Greg and allowing the removal of his son's organs, a move he says he regrets today.
"No human on Earth has the right to tell someone they can take someone's organs," he said.
