Anthrax Hoax Suspect Released On $25,000 Bail

SACRAMENTO (CBS/AP) ― The Sacramento man accused of allegedly mailing more than 120 hoax anthrax letters, has been released on $25,000 bail.

During today's hearing, U.S. Magistrate Kimberly Mueller decided that 66-year-old Marc M. Keyser will be released this evening on a $25,000 bond.

Mueller says the bond for 66-year-old Marc M. Keyser must be co-signed by a sister and brother-in-law. Mueller also barred Keyser from any activities intended to draw responses to a biochemical hazard.

Assistant U.S. Attorney Benjamin Wagner argued at Friday's court hearing that Keyser could flee and is likely to send more packages if he is freed. The prosecution also wanted to restrict Keyser's access to the Internet, but that motion was denied; however, the FBI obtained another warrant to search Keyser's home and took away his computer.

Assistant Federal Defender Rachelle Barbour says her client was trying to inform the public of its vulnerability to anthrax attacks.

Keyser was interviewed previously by the FBI after a similar mailing in 2007, but he was not charged.

Keyser allegedly sent a package containing a small aerosol can labeled "Anthrax," along with a compact disc, to the Sacramento News and Review newspaper, according a criminal complaint filed Thursday in federal court.

Keyser told agents then that he was using the mailing as a publicity stunt for a novel he had penned, and "to model what would happen if terrorist were to use anthrax ... to show the amount of anthrax a terrorist might spray into the air conditioning system in a shopping mall." The can did not contain anthrax.
