High Court Reviews Yolo Judges In Deputy Case

SACRAMENTO (AP) ― The California Supreme Court has ordered an independent review of whether Yolo County judges can hear the case of a man accused of killing a sheriff's deputy.

   Chief Justice Ronald George appointed Sacramento County Judge David De Alba this week to decide whether Marco Antonio Topete can receive a fair trial in Yolo County.

   Topete's attorneys say judges and deputies colluded to keep the public and reporters from attending the 35-year-old man's arraignment last month. Topete is charged with shooting 37-year-old Deputy Jose Diaz during a traffic stop near Dunnigan.

   Deputy Public Defender Dean Johansson says Yolo County judges shut down proceedings throughout the courthouse so their bailiffs could attend the arraignment.

   Presiding Judge David Rosenberg asked for the outside review. De Alba has set an Aug. 8 hearing.
