Call Kurtis: Good Neighbor Fence

The January wind storm took its toll on Gisele King's fencing. It was completely knocked to the ground. Her homeowners insurance, Mercury, covered half the 5-thousand dollar cost, and then told her it was a Good Neighbor Fence because she shared it with three others, and each would have to pay their share.
Gisele had no problem with the neighbor on one side paying their share, or the property management company on the other side, but the elementary school behind her refused.
Gisele backs up to Woodridge Elementary School in North Highlands. She contacted the school who referred her to the Rio Linda School District. They told her they wouldn't pay because it was a wood fence and not a chain link fence.
But Gisele had to replace it because she has a pool in her yard and was worried about the kids. So she still filed a claim with the district who is self-insured, for $759.00, their half of the back portion of her fencing.
They sent the claim back denied, claiming that they were not liable because they didn't cause it to go down, and they didn't put the fence there in the first place.
Frustrated she called me for help.
We called the agency that handles claims for the District who told us a claim was never filed. The District told us they didn't file one because they still don't think it's their responsibility. They offered to write a letter Gisele could hand to her insurance company hoping that they would go ahead and pay the whole thing, since the School District declared it was not a Good Neighbor Fence.
Gisele just wants her money. But still doesn't understand why she should be solely responsible for what appears to be a shared fence.
