Court Moves To Reinstate Ousted Garrido Lawyer

The Placerville lawyer who was replaced as kidnapping suspect Nancy Garrido's defense lawyer may be getting his job back.
Attorney Gilbert Maines was removed as Garrido's lawyer after El Dorado Superior Court Judge Douglas Phimister removed him from the case over an alleged conflict of interest. Garrido and her husband, Phillip, are charged with kidnapping, raping and holding Jaycee Dugard captive for 18 years.
Today, the 3rd District Court of Appeals in Sacramento ordered the El Dorado Court either to vacate the order dismissing Maines or explain to the court why they want to dismiss him.
In an earlier court filing, Maines disputed the alleged conflict of interest that led El Dorado Superior Court Judge Douglas Phimister to take him off the case.
In appealing the judge's decision, Maines revealed that someone had accused him of drunkenly discussing details of the case at his Placerville golf club and saying he would make money from a book or movie deal after the trial.
